Introduction

UNBOUND X INC. (“UnBound X,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (DMCA) and Copyright Policy outlines our procedures for responding to claims of copyright infringement on our website and mobile application (collectively, the “Platform”).

In accordance with the DMCA and other applicable copyright laws, we will respond expeditiously to valid notices of claimed copyright infringement and will terminate the accounts of users who are repeat infringers.

DMCA Takedown Process

For Copyright Owners: Filing a DMCA Notice

If you believe that content on our Platform infringes your copyright, you may submit a DMCA takedown notice. To be effective under the DMCA, your notice must include the following information:

Required Information

  1. Physical or Electronic Signature
    • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of Copyrighted Work
    • Identification of the copyrighted work claimed to have been infringed
    • If multiple works are involved, provide a representative list
  3. Identification of Infringing Material
    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity
    • Include specific URLs or other location information sufficient for us to locate the material
  4. Contact Information
    • Your contact information, including: 
      • Full legal name
      • Mailing address
      • Telephone number
      • Email address
  5. Good Faith Statement
    • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. Accuracy Statement
    • A statement that the information in the notification is accurate
    • A statement, made under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Our Response to Valid DMCA Notices

Upon receiving a valid DMCA notice, we will:

  1. Acknowledge Receipt (within 48 hours of the receipt of valid Notice)
    • Send confirmation that we received your notice
    • Provide a reference number for tracking
  2. Review and Verify (within 72 hours of the receipt of valid Notice)
    • Verify that the notice meets DMCA requirements
    • Locate the allegedly infringing content
  3. Take Action (within 72 hours of the receipt of valid Notice)
    • Remove or disable access to the infringing content
    • Notify the user who posted the content
    • Document the action taken
  4. Follow-Up (within 5 business days of the receipt of valid Notice)
    • Confirm completion of takedown action
    • Provide information about counter-notification process if applicable

DMCA Counter-Notification Process

For Users: Filing a Counter-Notification

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification.

Required Information for Counter-Notification

  1. Physical or Electronic Signature
    • Your physical or electronic signature
  2. Identification of Removed Content
    • Identification of the material that was removed or disabled
    • Location where the material appeared before removal
  3. Good Faith Statement
    • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Consent to Jurisdiction
    • Your name, address, and telephone number
    • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of New York if outside the United States)
    • A statement that you will accept service of process from the person who provided the original DMCA notice

Our Response to Counter-Notifications

Upon receiving a valid counter-notification:

  1. Forward to Original Complainant (within 2-3 business days)
    • Send copy of counter-notification to original copyright claimant
  2. Waiting Period (10-14 business days)
    • Wait for response from original claimant
    • Monitor for any legal action filed
  3. Restore Content (if no legal action filed)
    • Restore or re-enable access to the material
    • Notify the user of restoration

Repeat Infringer Policy

Three-Strike System

Users who repeatedly infringe copyright may face escalating consequences:

  1. First Infringement: Warning and content removal
  2. Second Infringement: Temporary account suspension
  3. Third Infringement: Permanent account termination

Serious Violations

For severe copyright violations, we reserve the right to immediately terminate accounts without prior warnings, including cases involving:

  • Commercial piracy or large-scale infringement
  • Circumvention of copyright protection measures
  • Willful and knowing infringement of registered copyrights

Appeal Process for Terminations

Users whose accounts are terminated may appeal by:

  1. Contacting support@unboundxinc.com within 30 days
  2. Providing evidence that infringement claims were invalid
  3. Demonstrating good faith efforts to respect copyright

What You Can Post

  • Original Content: Content you created yourself
  • Licensed Content: Content you have permission to use
